Terms of Service

These Terms govern your use of HollerShop, a local marketplace operated by HollerShop LLC, a Delaware limited liability company doing business as HollerShop. By using HollerShop, you agree to these Terms.
If you don't agree, don't use HollerShop.
1. What HollerShop is
HollerShop is an online marketplace that connects buyers with independent local vendors (farms, food producers, makers) and with physical pickup hubs in Western North Carolina. Buyers pre-order goods through HollerShop and pick them up at a hub or, for rental-property owners, have them delivered.
Vendors are independent businesses, not employees or agents of HollerShop. HollerShop facilitates the transaction and handles payment processing, but the underlying contract for the goods is between you and the vendor.
2. Accounts
- You must be at least 18 years old (or the age of majority in your state, whichever is higher) to use HollerShop.
- You must provide accurate information when you sign up and keep it accurate.
- You're responsible for activity that happens under your account. Sign-in is by email code — keep your email account secure.
- One account per person. Don't share accounts.
3. Orders, pricing, and payment
- Prices and product descriptions are set by vendors. We display them as provided.
- Hub pickup fee. Orders fulfilled via pickup at a HollerShop hub include a flat per-order fee of $2.00. This covers hub-attendant labor and payment-processing costs. The fee is shown on the cart and checkout pages before you pay; it is waived on shipping orders (which carry a separate shipping fee set by the vendor).
- Vendor commission.HollerShop retains a 13% commission on each vendor's item subtotal, out of which we cover payment processing. This is paid by the vendor out of their listed price and does not appear as a line item on your receipt.
- Delivery fee. Bulk deliveries to rental-owner properties carry a flat $10.00 per-order delivery fee, shown before checkout. Covers driver compensation, mileage, and hub-handoff labor.
- Payment is processed by Stripe. Your card statement will show HOLLERSHOP (or a similar descriptor).
- Sales tax.Where required by law, sales tax is calculated and added at checkout. North Carolina's marketplace facilitator law (NCGS § 105-164.4J) may require HollerShop to collect and remit sales tax on certain third-party vendor sales — we'll do so when applicable.
- Order acceptance.An order is not confirmed until the vendor accepts it and we send a confirmation email. If a vendor can't fulfill an order, we'll cancel and refund it.
4. Pickup and delivery
- Pickup orders.You select a pickup hub and a time window at checkout. If you don't pick up within the window, the hub may not be staffed and your order may spoil. We don't refund unpicked-up orders.
- Delivery orders (rental owners).We deliver to the address you provide, by the date and time window you select. You're responsible for ensuring the property is accessible (correct address, gate codes, drop-off instructions).
- Risk of loss passes to you when the order is handed off (pickup) or delivered (drop-off at the specified location).
5. Returns and refunds
Because most goods on HollerShop are perishable, returns are generally not accepted.
If your order is wrong, missing items, damaged on arrival, or spoiled, contact support@hollershop.com within 24 hours of pickup or delivery. We'll work with the vendor on a fix — typically a refund of the affected item(s) or a credit toward a future order.
6. Disputes and chargebacks
Before disputing a charge with your bank, please contact us. Most issues are easier and faster to resolve directly than through a chargeback. Filing a chargeback for an order you actually received may result in account suspension.
7. Acceptable use
You agree not to:
- Use HollerShop to defraud anyone, including vendors.
- Submit false or misleading information (including hub host applications or rental-owner subscriptions).
- Attempt to access another user's account, order, or data.
- Scrape, copy, or republish vendor product content for competing purposes.
- Interfere with the operation of HollerShop, including by probing for vulnerabilities without coordinating with us.
8. Vendor and hub host applications
Anyone can apply to sell on HollerShop or to host a hub. Approval is at HollerShop's discretion and is generally subject to a separate Vendor Agreement (for sellers) or Hub Host Agreement (for hub operators), which set additional terms specific to that relationship. Submitting an application does not create an obligation on our part to approve it.
9. Intellectual property
The HollerShop name, logo, and site design are owned by HollerShop LLC. Vendor product content (descriptions, photos) belongs to the vendor; by uploading it, vendors grant HollerShop a non-exclusive license to display and distribute it on the marketplace.
10. Disclaimers
HollerShop is provided “as is” and “as available.”We don't warrant that the marketplace will be uninterrupted, error-free, or that goods purchased through it will meet your expectations. We don't produce, package, or inspect the goods themselves — vendors do.
Food safety.Some HollerShop vendors operate under North Carolina's Home Processor or Cottage Food rules. Read product descriptions carefully if you have allergies or sensitivities.
11. Limitation of liability
To the maximum extent permitted by law, HollerShop LLC's total liability arising out of or related to HollerShop is limited to the greater of (a) the amount you paid HollerShop in the twelve (12) months before the claim arose, or (b) $100. We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to defend and indemnify HollerShop LLC against any claim arising from your misuse of HollerShop, your violation of these Terms, or your violation of any third party's rights.
13. Termination
We may suspend or terminate your account at any time if you violate these Terms or if your use creates risk for HollerShop or other users. You can close your account by emailing support@hollershop.com.
14. Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising out of or related to HollerShop will be brought exclusively in the state or federal courts located in Yancey County or Buncombe County, North Carolina, and you consent to personal jurisdiction there.
15. Local Business Directory
HollerShop also publishes a Local Business Directory — a listing of area businesses and service providers, separate from the marketplace. The following terms apply to it.
- Informational only. The Directory is provided for general information. HollerShop is not a party to, and is not responsible for, any transaction, agreement, or communication between you and a listed business.
- No endorsement or verification. A listing is not an endorsement, recommendation, or certification. We do not independently verify listed businesses, their services, or their licensing or insurance. Directory information is provided “as is” and may be incomplete or out of date.
- How listings are created.Some listings are compiled from publicly available and community-submitted information before the business has claimed them. A business may claim its listing to manage it, request corrections, or request removal at any time — see the “Request removal” link on the listing or contact us below.
- Claiming a listing. By claiming a listing you represent that you are authorized to act for that business, that the information and any logo or content you provide is accurate and that you have the right to use it, and you grant HollerShop a non-exclusive license to display it in the Directory. Claiming is edit-only and does not create a marketplace seller account.
- Intellectual property. Business names, logos, and marks shown in the Directory are the property of their respective owners and are used for identification only. If you believe a listing infringes your rights or should be removed, contact support@hollershop.com and we will address it promptly.
- Our discretion. We may edit, decline to list, or remove any listing at any time.
- No liability for dealings. To the maximum extent permitted by law, HollerShop is not liable for any loss or harm arising from your dealings with a business listed in the Directory.
16. Changes
We may update these Terms from time to time. We'll revise the “Effective” date and, for material changes, email registered users. Continued use of HollerShop after the effective date constitutes acceptance.
